Hi ubhat7712,
If the iPhone is linked to an iCloud account, and the Find My Phone is ON, then the only possible (legally) solution, is to ask the owner of the account the iPhone is linked to, to delete it from their account. (Which is difficult if the owner is deceased, but perhaps family has information?)
If that can't be done, then you have to contact Apple support WITH proof of original purchase. When that is verified, they will remove the lock and the phone can be wiped and reinstalled.
