If it still works I wouldn't even fix it because if it does stop you can turn it up when you turn it on or double click the home button or if u have certain headphones..... If it really bothers you I would not bring it to apple u less you have a protection plan and it still might cost money but apple will charge many charges and it won't be cheap so if you want it fixed I would suggest fixing it yourself ... Especially if it's jail broken then if you bring it In apple can sue you just reply to me if you have any more questions - ryan

Well, actually the part about "Apple being able to sue" is a bit controversial. Check here ( http://bits.blogs.nytimes.com/2009/02/13... ). Basically, criminal charges hinge on the basic concept of "legally legitimate". You can be sued by the authors of the apps you stole, for example, but you can't be sued for using, for example, self-written apps you wrote by yourself and never put on the Apple Store.

Apple can sue the hackers who created the Jailbreak, since they basically tampered with a closed source OS distributing a tool to "rewrite" it a notch. But, according to many jurisdictions, such as NY, and, AFAIK, some EU countries, you can't be criminally sued.

You should never bring a Jailbroken device to Apple, since you'd be liable of a breach of contract.

For the legal authorities Jailbreaking a device is like soaking it in a cup of water. Basically, you "chickened out" from a legally binding agreement (read: promise) between two individuals.
