Is it asking for Apple ID account and password? If yes you can't. The only way to get it unlocked is by contacting the original owner.

Jay, From forums I have read, if you are trying to activate an iPhone and it is asking for a previous owners Apple ID and password, you have encountered the activation lock. A security feature that prevents thieves from using a stolen or lost iPhone. You must contact the previous owner or who sold it to you to get permission to use the device. Previous owner can use/go to iCloud.com and remove the activation lock from there. If you cannot contact the previous owner return the device to where you bought it and get a refund.
If there is hesitation on their part I suggest you return the phone and get a refund.

If it is stolen. and Find My Phone is active, the knock on the door will be the police. If you see a lock symbol on it, you've been caught with stolen merchandise and I would immediately call the police and report it before they come to your house.
@mayer , Good point mayer, would be bad news, if it stolen phone.
I had a customer today whose 2014 MacBook Pro was taken out of his car last night. The purp turned it on, reformatted the drive and tried to install a system. The owners iPhone told him where it was, in thirty minutes he was in cuffs. I am doing a restore on it now, So the Find My Mac works!
