You can do it, but it requires the iPod touch to be reset, hopefully you have synced it recently with iTunes before it was stolen?

Ok so connect your iPod to iTunes

Hold power button and Home button (circle button) at the same time, maybe around 8 to 10 seconds.

It should now reboot (screen will go off), release JUST the power button, keep home button held down.

iTunes will say it has found an iPod in recovery mode.

Now just restore your iPod with your iTunes.

It will wipe everything first, then put it back on.

Can’t access your iPod? To reset a lost iPod password, follow these instructions.

1. Plug your iPod into your computer.

2. Make sure you have the latest version of iTunes.

3. If necessary, back up all your music. Though you may think that this is impossible with a locked iPod, the screen lock only protects the iPod interface itself; it doesn’t protect/encrypt any of the data inside, meaning you can still access it from your computer.

4. Restore your iPod. This will clear its contents and restore all factory settings.

5. Re-sync your iPod and apply a new password.
