Speaker produces static sound

well my 1 month old 3DS XL is producing this static and popping sound from the speaker...even if the volume is way down it will be on a consistent volume if not will be louder....weird thing is that if you insert a headphone, the headphone will produce the same sound...
at first i really am looking at a faulty speaker..but when the headset came in i was in dillema...if it is hardware should be the headset will be ok....but no...
so what do you think the problem is?

warranty is good sent it in a local repair shop.... :)
